‘Shariah Does Not Bar Women from Driving’

SAUDI GAZETTE: HAIL – Abdullah Al-Mutlaq, a professor of Comparative Fiqh (Islamic Jurisprudence) and a former judge at Hail court, has called for women to be allowed to drive, saying that there are no objections to it in Shariah and that “customs and traditions in our society must not rule us absolutely.”

Al-Mutlaq, speaking to Okaz newspaper, said that the study he was currently carrying out on the issue was motivated by a wish to tackle problems associated with foreign drivers being responsible for transporting Saudi females.

Al-Mutlaq said the move would serve to “prevent corruption” and noted “many negative observations concerning drivers.”

Al-Mutlaq said women should be allowed to drive, and cited the fact that many already do in rural areas with no resultant problems.

“They have earned respect with their abidance of traffic laws,” he said.

Al-Mutlaq called upon youth to respect women driving and expressed a wish for the issue to be treated as “normal”.

Al-Mutlaq’s comments support those expressed by Islamic thinker and former Minister of Information Dr. Mohammed Abdo Yamani, who told Al-Watan newspaper on Wednesday that women should be allowed to drive in Saudi Arabia.

Yamani appealed in an interview with Al-Watan to “the Grand Mufti, the Board of Senior Ulema’ and the Shoura Council to resolve the issue and relieve Saudi women of this injustice”.

“How can a person stop his wife and daughters driving a car without a Shariah text to support him, and then go and permit them to get in a car with a foreign man?” Yamani asked.

Visions of Sharia: Vengeance Allowed But No Less Barbaric

ORLANDO SENTINEL: Although the principle that "the personal is political" was first popularized by the American Women's Movement of the 1970s, the same wisdom may have much to teach us about relations between the West and Islam. The widely-publicized and ongoing tragedy of Ameneh Bahrami and Majid Movahedi offers a glaring example of precisely how.



At first glance, Bahrami's story seems like a tale of medieval injustice. After the Iranian electronics student resisted the persistent and unwanted advances of Movehedi for more than two years, he blinded and disfigured her in a 2004 acid attack.

Such attacks are still all too common in much of Asia -- most notably in Afghanistan, Pakistan, India and Bangladesh. They are often orchestrated against women who refuse to don the hajib or who resist unwanted proposals of marriage.

Such attacks are barbaric. However, Iranian law provides for an equally barbaric remedy. Under the Islamic rule of qias -- roughly translated as equivalence -- the victims of such attacks may demand identical treatment for their assailants. Bahrami, now receiving free medical care in Spain, has demanded that Movehedi be blinded too.



At her request, an Iranian court recently ordered that sulfuric acid be dropped into one of his eyes. (Apparently, since Iranian law does not view men's eyes and women's eyes as having equal value, Bahrami must pay 20,000 Euros if her spurned suitor is to lose both eyes.) >>> Jacob M. Living Under Sharia: The Plight of Women in Saudi Arabia

OEN: Islamic legal code, the Sharia, continues to make grounds in the West. Sharia Court, operational in Canada since 1991, was abolished in 2006 in the face of intense campaign from human rights activists. Although widely practiced by the Muslim community over the year, Sharia Court received official recognition in the U.K. for dealing with civil and some criminal cases (domestic violence etc.) in 2007. Since some 40% British Muslims want the establishment of Sharia Court with a fewer of them opposed to it, this is possibly the first-step in the gradual process of establishing full-fledged Islamic legal codes in Britain. As Muslim immigrants in the West, from Europe to North America, are showing increasing support for Sharia, demand for Sharia Court in other Western countries will definitely intensify in light of this British concession.

What people in the West must make themselves aware of is that Sharia laws are extremely discriminatory, indeed humiliating and degrading, toward non-Muslims. It is also highly discriminatory and humiliating toward Muslim women. In order to get a grasp of the nature of Sharia law, one may have a look at Afghanistan under the Taliban, Iran and Saudi Arabia, where Sharia laws are applied to varying strictness. In the wake of the just-concluded International Women’s Day, this essay will attempt to make it clear what Sharia law means for Muslim women.

When Australian Mufti Taj al-Din al-Hilali raised furor in 2006 by calling unveiled women “uncovered meat” to suggest that eighteen such white women, raped (some even gang-raped) by Muslim youths in a Sydney neighborhood in 2000, actually invited the horrendous act upon themselves. Most Australians and Westerners have viewed it as utterance of a deranged ignorant cleric, not representing the Islamic creed and community. However, an investigation of the treatment of women in Saudi Arabia—the birth-place and heartland of Islam—reveals a strong Islamic rational behind the Mufti’s assertion.

Saudi Arabia, the sacred land of Islamic devotion, is the best place for evaluating the status of women in Islam, where Islamic holy laws—the Sharia, which should ideally guide Islamic societies for eternity—are implemented most rigorously amongst Islamic countries. Make Sharia Part of UK Law, Says QC

DAILY EXPRESS: SHARIA law will “inevitably” become part of the legal system and work should begin now to incorporate it into British law, a leading barrister said last night.

Stephen Hockman, QC, former chairman of the Bar Council, spoke at a meeting organised by the website Islam4UK, where another speaker was Anjem Choudary, former head of banned fanatical group al-Muhajiroun.



Sharia law has become associated with executions, stonings and hands being cut off.



But Mr Hockman told the Daily Express: “Given our substantial Muslim population, it is vital that we look at ways to integrate Muslim culture into our traditions.



“Otherwise we will find that there is a significant section of our society which is increasingly alienated, with very dangerous results. 



“There should perhaps be a standing committee comprising Parliamentarians, lawyers and religious leaders to consider how this could be achieved and what legal changes might be framed.” >>> | Wednesday, November 26, 2008

Man Deserts Wife in Dubai, Converts to Islam and Remarries

DECCAN HERALD: A 39-year-old woman living in Dubai was allegedly deserted by her husband who converted to Islam and married another woman.

Vibha Suri, who now lives in the United Arab Emirates city, got to know in January this year that her husband Vikram Suri had married one Wassima Khan in October 2007, only after a letter from the Indian Consulate in Egypt reached her parents in Lucknow informing them about their son-in-law's second matrimony.

Vikram remarried in Egypt after converting to Islam.

"It has been a year now that my trauma and grief started. Vikram had violated our marriage by committing bigamy after he converted to Islam," Vibha said over phone from Dubai.

Vibha is now fighting a legal battle at the Delhi High Court as she accuses Vikram of restricting her children from travelling outside Dubai and violating an MoU that was finalised between them in February.

"Vikram used Shariat laws in UAE courts to restrict my children's travel outside the country. The MoU was agreed on issues relating to transferring of past financial assets and Vikram's moving out of our house in Dubai," she said. >>> New Delhi, PTI | October 19, 2008

From the Religion of Infinite Pleasure and Fun: Salsa Dancing Violates Shari’ah

AL ARABIYA NEWS CHANNEL: RABAT - Marrakesh will host its first international salsa festival amid controversy as officials and religious leaders expressed dismay over the city’s hosting of a festival devoted to the sexy Latin dance. 



The festival, which runs Oct. 8-12, features 100 dancers from Cuba, Mexico, Los Angeles, New York, Oslo, Milan, including Francisco Vasquez and Alex da Silva, choreographers for Shakira and Jennifer Lopez. The contestants will also give salsa classes to students of Moroccan universities.



But some locals voiced objections that the dance is un-Islamic and violates local social norms.

One Islamic scholar said the salsa festival violates sharia Islamic law. Mohamed Al-Taweel, pprofessor of jurisprudence at the University of al-Karaouine said that the festival is sinful for a number if reasons, no the least of which is the mingling between men and women. 



Moroccan sheikh Abdul-Bari al-Zamzami, a member of the Moroccan Scholars Association, told AlArabiya.net that the festival promotes vice among the youth, who are easily deceived by such Western activities. Europe's Sharia Question

ISN: ETH: ZÜRICH: In recent weeks, the European Commission and the UK have made apparent concessions to Islamic law, and with confrontations in Cologne over a proposed mosque, the role of Muslims in a future Europe is again in the spotlight, writes Simon Roughneen for ISN Security Watch.

Princeton University historian Bernard Lewis made his famous prediction in 2004: "Current trends show that Europe will have a Muslim majority by the end of the 21st century at the latest […]. Europe will be part of the Arab West-the Maghreb."
 


Similar claims have been made by other authors, with European countries featuring below-replacement birth rates, while Muslim immigrants and their descendants predicted, in some quarters, to reach over 20 percent of the population of Europe by 2020.



A low fertility rate of 1.47 babies per woman, according to the 2005 estimates for the EU as a whole, is far below the 2.1 needed to keep a population constant, and with newspapers reporting "Muhammed" as the most popular baby's name in London, the swing toward Mecca has some popular culture branding to match the statistics. Europe's Muslim population has tripled in the past 30 years, fuelled by immigration from North Africa, Turkey, Pakistan and Bangladesh.
 


No one knows whether or not he reads Lewis, but not to be outdone, Libya's Colonel Muammar Gadhaffi speculated in February 2006 that "we have 50 million Muslims in Europe. There are other signs that Allah will grant Islam victory in Europe, without swords, without guns, without military conquests. Ignoring Sharia's Advance Extremely Stupid

TOWNHALL.COM: The Washington Post's E.J. Dionne Jr. thinks there's "something peculiar" about conservatives who turn "Islamic extremism into a mighty ideological force with the power to overrun the world."

In a way, he's right. There is indeed something peculiar about portraying "extremism," Islamic or otherwise, as an ideological movement of sufficient mass and might to capture the world. After all, "extremism" is something "extreme" practiced by, well, "extremists." You know -- a few far-out kooks on the margins. Why worry? There's always that disclaimer that we, as a post-9/11 society, invoke when we talk about "Islamic extremism" (or, plain "extremism," as President Bush now prefers): Namely, that such extremism has nothing doctrinally or traditionally to do with Islam as practiced by the rest of the world's billion-plus Muslims. So much more reassuring to see things this way, at least as long as no one notes that Sharia (Islamic law) is advanced by "extremism" and Islam alike.

Of course, if Western society understands "extremism" merely as a marginal phenomenon, little wonder Dionne thinks it's odd that so many conservatives take it seriously -- specifically, he writes, "Osama bin Laden's lunatic claims that he will build a new caliphate." Isn't Bin Laden just an extremist fruitcake on Islam's fringe, who, naturally, makes "lunatic claims"? It should take not a war to subdue him, but a warden.
