DNA (India): London – Drug peddlers have been flogged, music shops closed and girls older than 13 barred from going to schools as Taliban enforces Islamic law in Pakistan's northeast Swat valley.
Taliban writ is the only thing that counts for those who break the Sharia law which has been implemented since the Pakistan Army has given up its control under an agreement with the militants to establish peace in the region.
In Mingora, 175 km from Islamabad, hooded Talibani enforcers are patrolling the streets and meeting out summary justice, The Times [of India] reported on Thursday. In front of large crowd they flog people who have broken edicts set by Taliban. Drug addicts and dealers are held down in the dust by heavily armed militants and flogged. They cry out in pain shouting for Allah. The punishment is brutal but has popular support, the report said.
The valley has now been transformed into Afghanistan of 2001. Under the agreement, Taliban can administer the region, run Sharia courts, ban women from marketplaces, outlaw music shops and stop girls above 13 going to school, the paper said.
"I send a message to the people of the West: stop spending money on tanks and aircraft and attacking the poor people of the world. Look after your own poor people and let us be. Change your policies. You cannot win here or in Afghanistan. Keep out," the report quoted Muslim Khan, a US educated English-speaking Taliban leader, as saying. [Source: DNA] | Thursday, March 26, 2009

GEO.tv: SARGODHA: Jamiat Ulema-e-Islam-S chief Maulana Sami-ul-Haq said on Sunday that he was ready to fight a war for the enforcement of Sharia across the country after Swat.
Addressing a news conference here, he said that alliance of the Muttahida Majlis-e-Ammal (MMA) had fell apart because its leadership went after the power politics.
JUI-S chief said that the future of democracy and present government looks bleak and disappointing, while crime rate in Swat went down to one percent following after promulgation of Sharia Law.

THE SUN: THE vile Muslim extremists behind the sick protests against Our Boys at a homecoming parade want Lord Mandelson stoned to death — for being GAY.
Hate preacher Anjem Choudary yesterday set out how he would deal with the Business Secretary if Britain was ruled under Sharia law.
At a bizarre press conference he called in London, he said Lord Mandelson would be RE-EDUCATED about the “evils” of homosexuality.
But the minister would be EXECUTED if he confessed to a male liaison.
Choudary, 41, who chillingly struck a pose like a video still of terror chief Osama bin Laden, said of Mandy: “He would not be allowed to speak openly about homosexuality.”
He added: “If a man likes another man, it can happen. But if you go on to fulfil your desire, there is a punishment to follow.

NAME: All Homosexuals Should Be Stoned to Death, Says Muslim Preacher of Hate
All homosexuals should face stoning to death, a Muslim preacher of hate declared yesterday.
Anjem Choudary, the firebrand cleric who wants to see Britain ruled by Sharia law, said such a regime was the only way to fix the country's ills.
Under it, adulterers and homosexuals would be killed by stoning. Asked if that would include anybody - even a Cabinet minister such as Business Secretary Lord Mandelson - Choudary responded with an astonishing diatribe.
He said: 'If a man likes another man, it can happen, but if you go on to fulfil your desire, if it is proved, then there is a punishment to follow. You don't stone to death unless there are four eyewitnesses. It is a very stringent procedure.
'There are some people who are attracted to donkeys but that does not mean it is right.'
Choudary was speaking at a press conference in London arranged by Muslim extremists to justify their protest in Luton last week against soldiers returning home from Iraq.
His incendiary remarks immediately prompted calls for him to be investigated by police. Tory MP Patrick Mercer said: 'These statements show the depravity of this man's beliefs. They must incite hatred and encourage terrorism, and I would encourage the Metropolitan Police to investigate them as rigorously as possible.'
The Rev Sharon Ferguson, chief executive of the Lesbian and Gay Christian Movement, said: 'This is appalling. The police should look very closely at what has been said to see if there is any action they should be taking.' >>> By Sam Greenhill | Saturday, March 21, 2009

TIMES ONLINE: Sharia Imposed on Northwest Pakistan in Deal with Taleban
The Pakistan Government has agreed to impose Islamic law across much of northwest Pakistan in an attempt to pacify a spreading Taleban insurgency.
The decision was announced after talks with a banned pro-Taleban group from the Swat Valley, a former tourist haven in the northwest where extremists have gained sway through beheadings and burning girls' schools.
Government officials said that laws that do not comply with Islamic texts have been suspended in Malakand region, which includes Swat, effective from today. >>> Jenny Booth | Monday, February 16, 2009

TIMESONLINE: Muslim communities should have the right to decide their own disputes provided they are subject to our laws, one of Britain's most senior legal figures has said.
Lord Bingham of Cornhill, who has recently stepped down as senior law lord, said he could see "no reason" why a devout Muslim, provided he or she was "acting voluntarily and without coercion", should not choose to submit a family dispute to a Muslim cleric.
That would be no different from a Jewish family submitting their dispute to be decided by a Rabbi or a Christian to a Church of England to an Anglican priest or marriage counsellor, he said.
But Lord Bingham, addressing the annual Bar Conference in London, made clear that there could be "no question" of any decision not being subject to the law of the country; nor of those involved forfeiting their rights to go to a court of law, he said.
He also emphasised that any such decision to have a dispute handled in this way as is already happening with Sharia councils in certain communities would have to be entirely voluntary. >>> Frances Gibb, Legal Editor | November 3, 2008

THE EARTH TIMES: Nairobi - The United Nations children's agency UNICEF Tuesday condemned the recent stoning to death of a 13-year-old Somali girl for adultery in the port town of Kismayo, which was taken over by Islamist insurgents in August. The girl, Aisha Duhulow, was last week stoned to death for adultery under Islamic law, or sharia. Initial reports said that the girl was in her twenties.
UNICEF said that reports indicated the girl had not committed adultery, but been raped by three men while walking to visit her grandmother in the capital Mogadishu.
The Islamic authorities said that the girl had confessed to her crime and repeatedly asked for the full penalty under sharia.
However, witnesses told the BBC that she begged for her life before being buried up to her neck in the ground and stoned by around 50 men in front of over 1,000 spectators.
"This is a tragic and deplorable incident" said UNICEF Representative for Somalia, Christian Balslev-Olesen. "A child was victimized twice - first by the perpetrators of the rape and then by those responsible for administering justice."
Insurgents have been fighting Somalia's transitional federal government since Ethiopian troops helped oust the Union of Islamic Courts in early 2007.
However, main insurgent group al-Shabaab has rejected the deal and vowed to keep fighting until Ethiopian forces leave Somalia.

THE TELEGRAPH: Sharia law is and must remain "subservient" to the English courts, Jack Straw has said.
The Justice Secretary told an Islamic conference that no court would ever endorse a sharia ruling that conflicted with English law and that the arguments against introducing a separate Islamic legal system were "overwhelming".
Mr Straw said: "There is nothing whatever in English law that prevents people abiding by Sharia principles if they wish to, provided they do not come into conflict with English law.
"There is no question about that. But English law will always remain supreme, and religious councils subservient to it."
His speech came days after Bridget Prentice, a junior minister in his department, suggested that rulings on divorce and custody of children made by sharia courts could simply be "rubber-stamped" by English courts. Miss Prentice's comments drew sharp criticism from the Conservatives and pressure groups.
Mr Straw said that while the courts could take sharia rulings into account, they must make their own decisions, which could not be disputed externally. >>> By Jon Swaine | October 30, 2008

THE TELEGRAPH: Britain's highest court allows a Lebanese woman to stay in Britain rather than lose her son.
The law lords ruled this morning ruled that it would be a “flagrant breach” of the European Convention on Human Rights for the government to remove a woman to Lebanon where she would automatically lose custody of her 12-year old son under Lebanon’s sharia family law.
The woman – referred to only as EM – came to the UK on false documents in 2004 with her son, AF, then aged eight. She has had sole custody of AF since birth but fled from her allegedly violent husband in Lebanon because of laws that automatically award fathers physical custody of their children from the age of seven.
Today’s decision reversed earlier rulings by the Court of Appeal, the Asylum and Immigration Tribunal and the Home Secretary that returning the woman and her son to Lebanon would not violate her right to family life despite the automatic separation of mother and child.
The leading judgment was delivered by Lord Hope. His comments on sharia are worth reading in full:
“The appellant came to this country as a fugitive from sharia law. Her son had reached the age of seven when, under the system that regulates the custody of a child of that age under sharia law in Lebanon, his physical custody would pass by force of law to his father or another male member of his family. Any attempt by her to retain custody of him there would be bound to fail. This is simply because the law dictates that a mother has no right to the custody of her child after that age. She may or may not be allowed what has been described as visitation. That would give her access to her son during supervised visits to a place where she could see him. But under no circumstances would his custody remain with her.
“The close relationship that exists between mother and child up to the age of custodial transfer cannot survive under that system of law where, as in this case, the parents of the child are longer living together when the child reaches that age. There is a real risk in all these cases that the very essence of the family life that mother and child have shared together up to that date will be destroyed or nullified. >>> By Joshua Rozenberg | October 22, 2008

MAIL Online: A Labour Muslim minister has warned that Islamic law is too unsophisticated for Britain.
Sadiq Khan said women could be ' abused' by sharia courts, which may give unequal bargaining power to the sexes.
He said: 'The burden is on those who want to open up these courts to persuade us why they should.'
Mr Khan, who was made a community cohesion minister in this month's Government reshuffle, rejected the argument that the courts could operate in the same way as the Jewish Beth Din courts.
He said Muslim life in Britain was not advanced enough to run a similar religious legal system.
The MP for Tooting in South London added: 'I would be very concerned about sharia courts applying in the UK.
'I don't think there is that level of sophistication that there is in Jewish law.'
He also said that sharia courts would discourage Muslims from developing links with other cultural and ethnic groups.
In February Dr Rowan Williams, the Archbishop of Canterbury, gave his support for the courts in Britain, saying that the legal recognition of them 'seems unavoidable'.
Mr Khan, who is a human rights lawyer and one of only a handful of Muslim MPs, said: 'The requirement to learn English is not colonial. English is a passport to participation in mainstream society - jobs, education and even being able to use health services.

THE SUNDAY TIMES: Gordon Brown's new minister for race relations has attacked sharia courts, insisting that the Muslim community in Britain is not “advanced” enough to have its own legal system.
Sadiq Khan, whose comments will have added impact because he is a Muslim himself, has also warned that the growing number of tribunals based on Islamic codes could entrench discrimination against women.
Khan, who became minister for community cohesion in the government reshuffle this month, said: “The burden is on those who want to open up these courts to persuade us why they should do it.”
His comments contrast with those of figures such as Lord Phillips, the lord chief justice, who said in July that Islamic law could be used to settle marital and financial disputes.
Rowan Williams, the Archbishop of Canterbury, has said the establishment of sharia courts in the future “seems unavoidable” in Britain.
In a wide-ranging interview on race and immigration, Khan, 38, the Labour MP for Tooting, south London, also: Warned that an economic downturn could fuel ethnic tensions. Demanded an increase in benefits for immigrants with larger families.
Admitted that government antiterror laws had caused “problems” in race relations. Called on public bodies to cut translation services to encourage immigrants to learn English.
Khan’s outspoken remarks on sharia courts are likely to cause the most controversy.

AL ARABIYA NEWS CHANNEL: RABAT - Marrakesh will host its first international salsa festival amid controversy as officials and religious leaders expressed dismay over the city’s hosting of a festival devoted to the sexy Latin dance.
The festival, which runs Oct. 8-12, features 100 dancers from Cuba, Mexico, Los Angeles, New York, Oslo, Milan, including Francisco Vasquez and Alex da Silva, choreographers for Shakira and Jennifer Lopez. The contestants will also give salsa classes to students of Moroccan universities.
But some locals voiced objections that the dance is un-Islamic and violates local social norms.
One Islamic scholar said the salsa festival violates sharia Islamic law. Mohamed Al-Taweel, pprofessor of jurisprudence at the University of al-Karaouine said that the festival is sinful for a number if reasons, no the least of which is the mingling between men and women.
Moroccan sheikh Abdul-Bari al-Zamzami, a member of the Moroccan Scholars Association, told AlArabiya.net that the festival promotes vice among the youth, who are easily deceived by such Western activities. I do hope that David Cameron knows that it is part of the ‘religion’ of Islam NOT to integrate with the infidel. So how is he going to bring integration about when the prophet of Islam himself told his adherents even to dress differently from the infidels, and thereby set themselves apart?
If Cameron is going to ban sharia courts, this is to be applauded. The current government doesn’t have the courage to take on the Muslims for several reasons. But one of these reasons is this: The majority of Muslim voters, I believe, vote Labour. - ©Mark
SUNDAY EXPRESS: A TOUGH package is being drawn up by David Cameron to tackle Islamic extremism. One of the key proposals is to ban sharia law courts from operating in this country.
In an exclusive interview with the Sunday Express, Mr Cameron’s security adviser, Baroness Pauline Neville-Jones, said the Tories were determined to “integrate” British Muslims into mainstream society.
Lady Neville-Jones, a former head of the Joint Intelligence Committee which advises the Prime Minister on terrorism, said: “We are not going to have any status for sharia courts. Absolutely not.”
Outlining the Tories’ wider plans for tackling Islamic extremism, she added: “We will be tough. We will be really tough on the men of violence and those who lead them to violence. That’s the real gap between us and the Government at the moment.”
She said the party would abandon the “blind alley of multiculturalism, which has deliberately gone down the road of separation for its own sake. We want unity and opportunity, despite difference, through integration.”
She was backed by Shadow Home Secretary Dominic Grieve, who said that multiculturalism had left a “terrible” legacy and created a vacuum exploited by extremists. The Tory plans also include:
Banning a string of groups blamed for encouraging Islamic extremism.
Working with other EU countries to change the Convention on Human Rights which has blocked the deportation of hate preacher Abu Qatada and others believed to be a threat to Britain.
Changing the school curriculum to encourage teaching of British values and make youngsters “proud of their country.”
In recent years, sharia courts have been established in a number of cities. The Archbishop of Canterbury, Rowan Williams, caused controversy by claiming the adoption of some aspects of sharia law was “unavoidable”.
Supporters claim the verdicts of sharia courts are already legally binding in a string of areas, including divorce, financial disputes and even cases of domestic violence and assault.
Critics insist the courts discriminate against women and undermine the rule of law. They also warn the use of Islamic law encourages a separatist agenda. Cameron: I’ll Curb Muslim Fanatics >>> By Jason Groves | September 28, 2008

BBC: In London's historic "Inns of Court", barristers practise law in the shadow of the distinctive medieval Temple Church. But does English law really owe a debt to Muslim law?
For some scholars, a historical connection to Islam is a "missing link" that explains why English common law is so different from classical Roman legal systems that hold sway across much of the rest of Europe.
It's a controversial idea. Common law has inspired legal systems across the world. What's more, calls for the UK to accommodate Islamic Sharia law have caused public outcry.
The first port of call when looking for an eastern link in the common law is London's Inns of Court.
"You are now leaving London, and entering Jerusalem," says Robin Griffith-Jones, the Master of the Temple Church, as he walks around its spectacular rotunda.
The church stands in the heart of the legal district and was built by the Knights Templar, the fierce order of monks-turned-warriors who fought Muslim armies in the Crusades.
London's historic legal district, with its professional class of independent lawyers, has parallels with the way medieval Islamic law was organised.
In Sunni Islam there were four great schools of legal theory, which were often housed in "madrassas" around mosques. Scholars debated each other on obscure points of law, in much the same way as English barristers do.
There is a theory that the Templars modelled the Inns of Court on Muslim ideas. But Mr Griffith-Jones suggests it is pretty unlikely the Templars imported the madrassa system to England. They were suppressed after 1314 - yet lawyers only started congregating in the Inns of Court after the 1360s.
Perpetual endowment
This doesn't necessarily rule out the Templars' role altogether. Medieval Muslim centres of learning were governed under a special legal device called the "waqf" under which trustees guaranteed their independence.
In an oak-panelled room in Oxford, historian Dr Paul Brand explains the significance of the 1264 statute that Walter De Merton used to establish Merton College.
