ADVOCATE: Draconian laws like those in Brunei are based on a misapplication of Sharia, which isn't really a legal code, Islamic scholars and activists say.

There has been, understandably, much outcry against the sultanate of Brunei’s imposition of what is often called Sharia law — a legal system based on Islam. But Sharia is not monolithic, according to many scholars of Islam; it can be and is interpreted in different ways from one country to another. And some point out that referring to Sharia as “law” is problematic — it’s a religious way of life.

Brunei, ruled dictatorially by Sultan Hassanal Bolkiah, began incorporating aspects of Sharia into its penal code in 2014, causing international outrage and a boycott of the luxury hotels owned by the sultan’s company, the Dorchester Collection. THE GUARDIAN: Penal code that imposes death by stoning for gay sex is serious setback for rights, says commissioner

The United Nations has condemned “cruel and inhuman” laws set to take effect in Brunei this week that impose death by stoning for gay sex and adultery, and amputations for theft.

“I appeal to the government to stop the entry into force of this draconian new penal code, which would mark a serious setback for human rights protections for the people of Brunei if implemented,” the UN high commissioner for human rights, Michelle Bachelet, said in a statement.

Brunei, an absolute monarchy ruled for 51 years by Sultan Hassanal Bolkiah, has said it will implement the code starting on Wednesday.

Brunei first announced the measures in 2013, but their implementation has been delayed in the face of opposition by rights groups, and as officials worked out the practical details.

The law stipulates the death penalty for a number of offences, including rape, adultery, sodomy, robbery and insulting or defaming the prophet Muhammad.

Elton John has joined George Clooney in calling for a boycott of nine Brunei-owned hotels over the sultanate’s new death penalty laws for gay sex and adultery.

“I commend my friend, George Clooney, for taking a stand against the anti-gay discrimination and bigotry taking place in the nation of Brunei – a place where gay people are brutalised, or worse – by boycotting the sultan’s hotels,” the singer wrote on his Twitter page late on Saturday.

The 72-year-old, a veteran gay rights campaigner, said his “heart went out” to staff at the hotels, but that “we must send a message, however we can, that such treatment is unacceptable”.

Brunei is to begin imposing death by stoning as a punishment for gay sex and adultery from next week, as part of the country’s highly criticised implementation of sharia law.

From 3 April, individuals in the tiny southeast Asian kingdom will be subject to a draconian new penal code, which also includes the amputation of a hand and a foot for the crime of theft. The capital punishments are to be “witnessed by a group of Muslims.”

Brunei, which has adopted a more conservative form of Islam in recent years, first announced back in 2014 its intention to introduce sharia law, the Islamic legal system which imposes strict corporal punishments. First there was surprise, then shock, then anger. By nightfall thousands across India had taken to the streets in spontaneous protests against an unexpected supreme court decision on Wednesday reversing a judgment that had decriminalised gay sex in the country.

Activists had expected the court simply to rubber-stamp the original 2009 ruling. Now India will rejoin the more than 70 countries – mainly in Africa, the Middle East and south Asia – where homosexual relations are illegal.

The reinstatement of a 153-year-old law passed under British rule and based on 16th-century English legislation means "carnal intercourse" between consenting adults of the same sex is once more defined as "unnatural" and punishable by up to 10 years in jail. Waving multicoloured flags and wearing black bandanas, the crowd of protesters that gathered at the Jantar Mantar, a favourite point for demonstrations in the Indian capital, Delhi, was full of young men and women.

THE DAILY TELEGRAPH: The Archbishop of Canterbury voiced opposition to same-sex couples adopting children and insisted that the Bible is “clear” that gay couples should not have sex, previously unpublished writings show.


Justin Welby also privately warned of a crisis facing the Church of England as a result of dwindling numbers and financial pressure which could even pose “serious questions of viability” within the next seven to 10 years.

And he openly questioned the formality of the Established Church, wondering aloud whether Jesus would have approved of “big buildings” and elaborate clerical dress.

His comments are disclosed in the first biography of the new leader of the world’s 77 million Anglicans, who will be formally enthroned in Canterbury later this month.

It charts his transformation from a highly paid City oil executive to life on a clerical stipend before his rapid promotion through the ranks of the Church.

It also reveals some of the most unguarded comments of the future Archbishop yet published, dating from his time as a little known parish priest just over a decade ago.

More recently, he voiced frustration at being branded a homophobic “European Taliban” for advocating traditional views on sex.

THE TELEGRAPH: The Catholic Church in Italy was embroiled in a fresh scandal on Friday when photographs apparently showing homosexual priests attending gay nightclubs and engaging in casual sex were published in a magazine.

A journalist from Panorama, a conservative weekly news magazine owned by Silvio Berlusconi, the Italian prime minister, used a hidden camera to film interviews with three gay priests, who introduced the journalist to the gay clubs they apparently frequent, and allowed the journalist to film their sexual encounters with strangers, including one in a church building.

One of the priests, a Frenchman identified only as Paul, celebrated Mass in the morning before driving the two escorts he had hired to attend a party the night before to the airport, Panorama said.

CATHOLIC CULTURE: Following a student complaint, the University of Illinois refused to renew the contract of Dr. Kenneth Howell, an adjunct religion professor, who wrote in an e-mail that “Natural Moral Law says that Morality must be a response to REALITY” and that “sexual acts are only appropriate for people who are complementary, not the same.” Dr. Howell, who taught courses on Catholicism at the university and was recognized for excellence in teaching in 2008 and 2009, wrote the e-mail to his students to help them prepare for their final exam; in the e-mail, he compared utilitarianism and the natural moral law.

“Teaching a student about the tenets of a religion is one thing. Sex education is to be made compulsory in all state schools in England but faith schools will also be free to preach against sex outside marriage and homosexuality, under government proposals.

The plans to make personal, social and health education (PSHE) compulsory from the age of five, published yesterday, include a clause allowing schools to apply their "values" to the lessons and another allowing parents to opt their children out on religious grounds.

It means that all state secondaries in England - including faith schools - will for the first time have to teach a core curriculum about sex and contraception in the context of teenagers' relationships, but teachers in religious schools will also be free to tell them that sex outside marriage, homosexuality or using contraception are wrong.
